Privacy Policy And Data Processing

This Privacy Policy applies to all users of our Platforms and related applications that may refer to this Privacy Policy, collectively referred to as “our Platforms”.


This privacy policy has been compiled to comply with the POPI Act (the Protection of PII Act 4 of 2013 ) and describes how “Personally Identifiable Information” (hereinafter referred to as ‘PII’) is being used online.


By using this website or any of our Platforms, you accept and consent to the following:


PII is information that can be used on its own or with other information to identify, process, contact, or locate a person or persons, or to identify an individual in context.


PII may be accessed, used and processed in conjunction with our partners, who may include 3rd parties, to improve the probabilities of the successful placement of candidates who have submitted their PII on any of our Platforms.


Please read Manna Employment Services' privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your PII.


1. What PII do we collect from people via our Platforms?

We expressly collect personal details including employment history and related data through our onboarding process, however, we may also collect other statistical information during verification processes and also Platforms usage data when you interact with the Platforms.


2. When do we collect information?

We collect information from you when you voluntarily register on any of our Platforms. We also collect information on web pages visited as you browse the Platforms.


3. How do we use your information?

We may use your PII to promote your employment profile to 3rd parties, including employers and recruitment partners. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send, or you may contact us via the information contained on the Platforms. 


The main reasons for collecting, accessing, collating and processing PII include the following:

  • With regard to applicants seeking employment, we process, collate and distribute PII for the purposes of optimising the probability of successfully placing the candidate in a position of employment, or, obtaining a better position of employment than what they currently enjoy;
  • With to the general use of our Platforms, we seek to optimise your user experience, to provide you with information and online tools in the most clear and efficient manner.


We hold onto your PII as long as:

  • We require it to provide you with our Platforms, products, or services.
  • It's mandated or permitted by law and aligns with our internal storage policies.
  • It's essential to uphold the contract between you and us.
  • You've given consent for us to retain your PII, pending your request to cease processing it.


We will retain your PII for the necessary duration to achieve the purpose for which it was initially collected or subsequently processed. If your PII serves multiple purposes, we will maintain it until the purpose with the most recent timeframe expires. However, we'll cease using it for purposes with shorter timeframes once those periods end.

By utilizing and accessing the Platform, you provide consent for us to maintain records of your PII for no longer than necessary to fulfil the initial or subsequent purposes for which the data was collected.


4. How do we protect your information?

We ensure that the confidentiality and integrity of your PII in our possession or control is maintained through appropriate and reasonable technical and organizational measures. These measures are put in place to prevent the loss, damage, or unauthorized destruction of PII, as well as unlawful access or processing of such information.


To enforce and uphold these measures, we have established policies, controls, and related processes that are regularly reviewed and updated. Our policies and procedures encompass various aspects, including:

  • Physical, technical, and network security measures.
  • Access controls and continuous monitoring of access.
  • Secure storage, encryption, and proper destruction of PII records.
  • Reporting and remediation procedures for any breaches of PII.
  • Imposing security and confidentiality obligations on third parties (whether within or outside the borders of South Africa) who process PII on our behalf, through written agreements.


Our Platforms are regularly updated and are scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

  • We use regular Malware Scanning.
  • We use an SSL certificate.


5. Can I choose not to receive direct marketing?

You have the right to request that we refrain from contacting you for direct marketing purposes via electronic communication methods, such as automated calls, emails, and SMS notifications. This can be accomplished by opting out of any direct marketing communications we might send your way.


6. If you are below the age of 18

If you're younger than 18, you need your parent or guardian to say it's okay before you use our Platforms or share your PII with us. We might want to make sure they said yes, so we can ask you for their contact details to talk to them. We'll also make sure the details you gave us are right and belong to your parent or guardian. If we can't check the permission or if your parent or guardian tells us you don't have their okay, you can't use our Platforms.


Where it is against the law to employ an applicant below a certain age, we will decline such application.


7. Sending of PII outside of South Africa

We may transfer certain PII outside the geographic borders of South Africa to service providers for purposes set out above, including for data storage and backup purposes to ensure the integrity of our systems.


When we transfer your PII outside of the geographic borders of South Africa, we will ensure that we do so in accordance with the requirements for lawful transfer outside of South Africa as set out in POPI.


By accessing and using our Platforms, you consent to us transferring your PII outside of South Africa as set out in POPI.


8. What additional rights do I have in respect of my PII?

Upon providing sufficient proof of your identity, you have the following rights:

  • The ability to view, correct, and/or amend the PII we process about you. Registered users can do this through their user accounts, where their PII is stored.
  • The right to request a record or description of your PII. We reserve the right to charge a fee for providing this record, and in cases where access and amendment requests are deemed manifestly unfounded, excessive, or repetitive, an additional administrative fee may be charged or the request may be refused.
  • The right to request the correction, destruction, or deletion of your PII. If you decide to no longer be a registered user by cancelling your account, We will retain your PII in compliance with legislative requirements and/or our internal retention policy.
  • We will comply with your requests unless there is a credible reason preventing us from doing so.
  • If we can't agree on whether to correct or delete your PII as requested, we will indicate that a correction or deletion was requested but not carried out.
  • We will inform you if any changes are made to your PII that might impact decisions about you, where reasonably practicable.
  • You will be notified of the actions we take based on your requests.
  • You will be informed if there is any unauthorized access to your PII.
  • We will provide reasonable evidence of our adherence to the obligations outlined in this Privacy Policy upon reasonable notice and request.
  • You have the option to submit a complaint to the Information Regulator.


If you have any complaints about this Privacy Policy or our compliance with this Privacy Policy you can lodge a complaint with the Information Regulator.

9. Do we use ‘cookies’?

Yes, we do. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enable the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in our shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. 10. Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your PII unless we provide users with advance notice. This does not include our promotional partners, who may provide additional services to promote applicants, hosting partners and other parties who assist us in operating our Platforms and conducting our business. We may also release information when it’s release is appropriate to comply with the law, enforce our site policies, or protect our or others’ rights, property or safety.


Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. We use the following third-party Service Providers to monitor and analyze the use of our Service.


Google Analytics

Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google utilizes the Data collected to track and examine the use of these Platforms, to prepare reports on its activities and to share them with other Google services. Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. We use Google AdSense Advertising on our Platforms. Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.


Facebook Ads Conversion Tracking

Facebook Ads conversion tracking is an analytics service provided by Facebook, Inc. that connects data from the Facebook advertising network with actions performed on this Platform.


11. International Rights

According to the EU General Data Protection Regulation that came into effect on 25 May 2018, you have a right to be informed of Personal Data processed by Manna Employment Services, and a right to rectification/correction, erasure and restriction of the processing. You also have the right to receive a structured, common and machine-readable format of the Personal Data you provided to us.


We can only identify you via your email address and we can only adhere to your request and provide information if we have Personal Data about you through you having made contact with us directly and/or you using our site and/or service. We cannot provide, rectify or delete any data that we store on behalf of our users or customers.


To exercise any of the rights mentioned in this Privacy Policy and/or in the event of questions or comments relating to the use of Personal Data you may contact us via care@chpc.org.za


You have the right to withdraw consent at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the site and/or services. You further agree that Manna Employment Services shall not be held liable with respect to any loss and/or damage to your Personal Data if you choose to withdraw consent.


In addition, you have the right to lodge a complaint with the data protection authority in your jurisdiction.


12. California Online Privacy Protection Act

Even though we are based in South Africa we subscribe to CalOPPA practices. CalOPPA is the first state law in the USA to require commercial platforms and online services to post a privacy policy. The law’s reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates platforms collecting PII from California consumers to post a conspicuous privacy policy on its Platforms stating exactly the information being collected and those individuals or companies with whom it is being shared.

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously.
  • Once this privacy policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our Platforms.
  • Our Privacy Policy link includes the word ‘Privacy’ and can easily be found on the page specified above.
  • Check the Privacy Policy Page regularly to view changes.
  • Users can change their PII by logging in to their accounts.


13. How does our site handle Do Not Track signals?

We honour Do Not Track signals and Do Not Track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.


14. COPPA (Children Online Privacy Protection Act)

When it comes to the collection of PII from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, and the United States Consumer Protection Agency, enforces the COPPA Rule, which spells out what operators of platforms and online services must do to protect children’s privacy and safety online. In addition, we do not specifically market to children under the age of 16 years old.


15. Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to complying with the various privacy laws that protect PII.


In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify you via email
  • We will notify you within 7 business days


We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.


16. CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.


We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions
  • Process orders and send information and updates pertaining to orders.
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.
  • To be in accordance with CANSPAM, we agree to the following:
  • Not use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.
  • Include the physical address of our business or site headquarters.
  • Monitor third-party email marketing services for compliance, if one is used.
  • Honour opt-out/unsubscribe requests quickly.
  • Allow users to unsubscribe by using the link at the bottom of each email.


If at any time you would like to unsubscribe from receiving future emails simply follow the easy unsubscribe instructions at the bottom of each email and we will promptly remove you from ALL correspondence.

18. Effective date of Privacy Policy and Review Process

This Privacy Policy came into effect on 13 September 2023

The Policy will be reviewed and amended if required on any change in:

  • Technology available or used, or,
  • business practices or,
  • legislation or,
  • common law,

 that may have an effect on it, or otherwise, every 12 months.
